Biography
Shelby Schwartz is Counsel at Mitchell Sandler. Her practice focuses on financial regulatory and compliance matters, with a concentration on deposit accounts and financial data privacy. She holds the Certified Information Privacy Professional – US (CIPP/US) certification from the International Association of Privacy Professionals. She advises a wide variety of financial services providers, from banks to financial technology companies.
Shelby has successfully assisted clients in responding to regulatory inquiries and enforcement matters, including those brought by the Federal Trade Commission, the Consumer Financial Protection Bureau, the Department of Justice, and various state regulators. She regularly assists clients in assessing their deposit account fee structures, deposit account agreements, and electronic funds transfer issues. With respect to financial data privacy, Shelby assists clients in developing privacy policies, analyzing coverage under state data privacy laws, assessing whether data breaches have occurred or triggered reporting requirements, understanding requisite consents and constraints related to using personal information for various marketing purposes, and developing financial products and services using fair information privacy principles.
Before joining Mitchell Sandler, Shelby worked as the compliance program manager for Promontory Financial Group, an IBM company, focusing on various compliance risks, including information security and data privacy, corporate governance, and the Foreign Corrupt Practices Act. Her work included developing compliance policies, procedures, and training programs, investigating complaints, overseeing vendor management, and other due diligence matters. Prior to that, Shelby was an associate at Littler Mendelson PC where she handled both advisory and litigation matters for a wide variety of corporations, focusing on discrimination, retaliation, and noncompetition matters.
